This is a booklet containing a record of land transfers from 1820 to 1917 of a tract of land on the south of side of Cape Girardeau along Sprigg Street. This fascinating document mentions quite a few historical figures, including Louis Lorimier, Bartholomew Cousins, Daniel Steinbeck, Andrew Giboney, Louis Houck, and Robert Sturdivant.
In 1918 or so, a commission was appointed to divide the large Spanish land grant of Louis Lorimier which encompassed the entire town of Cape Girardeau. The booklet traces how 160 acres of Lorimier's tract was divided up and how these two "out lots" were transferred from person to person until they landed into the possession of Louis Houck (through his wife Mary Giboney) who ended up turning them (and other lots) into a series of subdivisions.
The booklet was published by the Naeter Brothers (founders of the Cape Girardeau Republican, now the Southeast Missourian), presumably in 1917, for Mr. M. E. Leming, another prominent figure in Cape history.

The first portion of this document (pages 1 through 25) traces the history of Out Lot 50 and the next portion (pages 26 through 40) covers Out Lot 51. The final portion starting at page 40 covers both lots in the years leading up to 1911.

Whereas by an order of the Circuit Court for the County of Cape Girardeau Term of August 1819 on the Petition for partition of the lands belonging to Louis Lorimier, Daniel F. Steinbeck, and Agatha his wife, Victor Lorimier and Thomas Jefferson Rodney and Polly Rodney, children and heirs of Maria Louisa, daughter of Louis Lorimier deceased, and late wife of Thomas S. Rodney, their present guardian, all heirs and representatives of the said Louis Lorimier deceased. It was ordered and directed by the said Court that the commissioners before appointed for the division of said lands do sell the same at public vendue as surveyed and laid off into lots and parcels and that they or a majority of them do make conbeyances to the purchasers taking mortgages etc.
Therefore, we the undersigned as Commissioners so appointed and by virtue of the authority vested in us for and in consideration of the sum of $1480.00 being the amount of the last and highest bid made at public auction for the out lots hereinafter described and for the seven eighths of which sum the purchaser Van B. Dlashmutt having paid the one eighths part thereof has Given his obligation secured by mortgage on the premises, we by these presents do give grant sell assign and convey and enfeoff unto the said Van B. Dlashmutt his heirs and assigns for ever the said out lots to-wit: Two out lots on the south of said town containing each 80 acres more or Iess, and designated under numbers 50 and 52 on the map made out from the filed notes of the surveyor who measured the same to which reference may be had for further particulars, and other lands.

Daniel F. Steinbeck, Deceased.
In the name of God, Amen.
I, Daniel F. Steinbeck of the town and County of
Cape Girardeau, and the state of Missouri, being of sound and disposing mind and memory and understanding and considering the certainty of death and the uncertainty of the time thereof and being desirous, (when ever my dissolution takes place) to leave my worldly affairs in such order that all and every kind of business in which I am in any way interested or concerned may (as far as circumstances will permit) be adjusted and settleed without judicial proceedings, and with as little trouble and expense to my family as possible do make and publish this my last will and testament in the manner and form following:
1st. After the payment of my just debts, funeral expenses, and such legacies, as hereinafter mentioned, I give and bequeath to my beloved wife, Agatha, all my household and kitchen furniture and one third of all my other personal property, and the other two thirds of my personal property I give and bequeath to my dear children George Louis and Dorothea Louisa, Adeline Rebecca, Bartholomew Cousins Agnes Maria and such other children of mine (if any) as may hereafter be born to my wife Agatha, to be equally divided amongst them.
2nd. I give and bequeath to my said wife Agatha, all my real estate situated and belonging in the state of Missouri and Illinois, or elsewhere to be holden by her during her natural life; and I give and bequeath all my said real estate, after the death of my said wife, Agatha to my said children George Louis, Dorothea Louisa, Adeline Rebecca, Bartholomew Cousins and
Agnes Maria, and such other children of mine (if any) as may hereafter be born to my said wife Agatha, to be equally divided among them.
3rdly. I begueath to Elizabeth Lightner wife of Levi L. Lightner, a certain house and lot in the town of Cape Girardeau being the same house and lot formerly owned by her father, Peter Dodar.
4th. I bequeath to my nephew William Steinbeck of the town of Ronney in Virginia a certain house and
lot in Cape Girardeau, whereon Doctor Erasmus Ellis now lives.
5th. I bequeath to my friend Thomas Byrne of Cape Girardeau County and State of Missouri one half the lot of ground in the town of Cape Girardeau whereon Majr. Louis Lorimier, deceased, formerly lived, to be taken adjoining Lot No. 9 and No. 12 now owned by said Byrne on condition that all accounts heretofore existing between me and said Byrne be considered as finally settled; I also bequeath to the said Thomas Byrne as a token of friendship my Blunderbus and brace of pistols.
6th. I bequeath to Raphael V. Lorimier the use and benefit of a certal lot in the town of Cape Girardeau being No. 19 in Range G and a certain out lot adjoining said town containing about three and quarter acres and designated under Letter "K" on the map made out from the field notes of the surveyor who measured the same., for the term of his natural life and after his death, I give and bequeath said lot to my children before mentioned, to be equally divided among them. I also bequeath to the said Raphael V. Lorimier one rifle gun now in his possession and my silver watch which I wish him to accept as an expression of my friendship for him.
7th. Being seriously impressed with the belief that the establishing of schools for the education of poor children, leads to the discovery and brings into useful exercises, the talent of many which would otherwise remain in obscurity forever, and being desirous that the town of Cape Girardeau may at some future period reap the benefit of such and institution it is my wish if (in the opinion of my executrix and executors hereinafter named, the circumstanees of my estate will admit it without material injury to my family) that a fund of five hundred dollars be created out of my estate whenever in the opinion of my executrlx and executors the circumstances of the estate will justify it, and by them put out on interest from year to year making at the end of every year the interest a part of the prin-
cipal to be put to interest the insuing year until such time as such a seminary of learing may go into operation in the town of Cape Girardeau., at which time, I authorize my executrix and executors to pay over to the trustees of such seminary the sum of five hundred dollars together with all interest which may have therefrom, the principal to be continued by the with interest and the interest applied therefrom to be used by them from year to year, for the education of such poor ehildren as they in their discretion may think proper.
8th. I do hereby appoint and constitute my beloved wife, Agatha, Executrix and my friend Peter Menard of Kaskaskia, Illinois, and Thomas Byrne of Cape Girardeau County and State of Missouri executors of this my last will and testament, and inasmuch as it is my most earnest wish and desire that in settling my business all expense and judicial proceedings (as far as the nature of circumstances will possibly admit) be avoided I do hereby give my said executrix full and complete power (with the advice and eonsent of my
said executors) to settle amicabley with the with the debtors and creditors of my estate, to allow any credits they may deem just, to compromise any difficulties or disputes that may arise with the said creditors, or debtors of my estate in the settlement of their aecounts; and to do or perform any other act in the settling of said estate which in their opinion will be beneficial to the legatees or devisees, and should the said executrix find it necessary for the payment of any of my just debt or debts to sell any lot or lots, tract or tracts of land of which I may die siezed, I do hereby give her full and ample power, (with the advice and consent of my said executors) to sell and convey the same or any part thereof, and I do herehy direct and appoint that my said wife Agatha (with the aid and advice of said executors) shall have the tuitionship and guardianship of my said children during their minority respectively; and I do earnestly entreat their care and attention respectively in and about the morals and education of my said childred and I do hereby revoke and annull
all former wills by me made, ratifying and confirming this to be my last will and testament.

Steinbeck, Peter Menard one of the executors and Agatha Steinbeck the executrix named in the will of the deceased, having refused and renounced the executorship of the said will and said Thomas Byrne having given bond with proper securities and taken the proper oaths.

Know ye that I, Andrew Giboney of Cape Girardeau County in the State of Missouri, being aged and infirm of body but of sound and disposing mind and memory, wishing to make disposition of my worldly affairs, while I have strength to do so, do make and publish this my last will and testamant.
That is to say:-
1stly. I give and bequeath to my wife Saran H.
Giboney, the sum of Fifteen Thousand Dollars, which is to be lieu of and in satisfaction of dower, claim of homestead or any other claim or demand arising out of the law of the State of Missouri or any other law, whether as widow or heir, the said sum of fifteen thousand dollars being intended as full payment and satisfaction of any interest which my said wife may have or be supposed to have in my estate.
2ndly. I give and bequeath to my grandnephews Stephen Ranney, Robert G. Ranney and William A. Ranney the sum of Fifty Dollars each.
3rdly. I give and bequeath to my grandnephew Herbert Ranney the sum of one hundred dollars.
4thly. I give devise and bequeath to my Daughter Mary H. Houck all the ballance of my estate, real, personal and mixed, of whatsoever kind nature or description or whereever situated everthing that I now own or may own at the time of my death.
5thly. It is my will and desire and I hereby direct that the legacies mentioned in articles 2nd and 3rd of this will shall be paid out of the first moneys collected by my executor.
6thly. I do hereby assign and transfer to my daughter Mary H. Houck all notes and accounts due to me or which may hereafter become due to me and also my mortgages and deeds of trust by which they may be secured.

Ranney, the subscribing witnesses to the will of Andrew Giboney, now before this Court for Probate, and being first duly sworn depose and say that the said Andrew Giboney, the testator, subscribed the same in their presence, and published the said will or instrument of writing as his last will, that he, the testator, was at the time of publishing his will, of sound mind, and more than twenty years of age, and that they the said deponents, attested the said Will as witnesses thereto, by subscribing their names to the each other. And the Court after healng the testimony of said witnesses and after examination of said instrument of writing, both order, adjudge and declare said instrument of testament of Andrew Giboney deceased and that the same be admitted to Probate.

Louis Houck administrator with the will annexed of said estate comes and presents his final settlement verified by affidavit which is approved by the court and ordered to be filed.
He charges himself with the sum of $39,182.15
He is allowed credit for the sum of $39,182.15
And the court upon the adjudication of the same finds said administrator with the will annexed paid over to the legatees under the will of said deceased, the sum bequeathed to them as appeares by their receipts filed in the final settlement herewith. To Robert G. Ranney the sum of Fifty Dollars, to Herbert Ranney one hundred dollars, to heirs of Stephen Ranney fifty dollars, to Mrs. Sarah N. Giboney widow of said deceased fifteen thousand dollars, to Mrs. M. H. G. Houck, daughter of said deceased the sum of $15,141.84 and that he has paid over all amounts in his hands as such administrator and that notice of said final settlement has been given aceording to law, and it is therefore ordered that said administrator be finally discharged.

Sold by order of the Circuit Court of Cape Girardeau County, made at August Term, 1819, on a petition for partition of lands belonging to Louis Lorimier. Daniel F. Steinbeck and Agatha, his wife, Victor Lorimier, and Thomas Jefferson Rodney and Polly Rodney, children and heirs of Marie Louisa, daughter of Louis Lorimier, deceased, and late wife of Thomas S. Rodney, their present guardìan, all heirs and representatives of said Louis Lorimier, deceased, wherein it was offered and directed by said Court that the Commissioners before appointed for the division of said lands, do sell the same at public vendue as surveyed off into lots and parcels, and that they or a majority of them make conveyances to the purchasers, taking mortgages, etc. The undersigned as Commissioners so appointed, by virtue of the authority in them, for the sum of $330.00 being the amount of the last and highest bid made at public auction for an Out Lot hereinafter described and for residue of which sum the purchaser, Valentine Miller (having paid 1-8 thereof) has given his obligations secured by Mortgage on the premises.

Know ye that I, Andrew Giboney of Cape Girardeau County in the State of Missouri, being aged and infirm of body but of sound and disposing mind and memory, wishing to make disposition of my worldly affairs, while I have strength to do so, do make and publish this my last will and testamant.
1stly. I give and bequeath to my wife Saran H. Giboney, the sum of Fifteen Thousand Dollars, which is to be lieu of and in satisfaction of dower, claim of homestead or any other claim or demand arising out of the law of the State of Missouri or any other law, whether as widow or heir, the said sum of fifteen thousand dollars being intended as full payment and satisfaction of any interest which my said wife may have or be supposed to have in my estate.
2ndly. I give and bequeath to my grandnephews
Stephen Ranney, Robert G. Ranney and William A. Ranney the sum of Fifty Dollars each.

Twenty feet of the west side of Out Lots Fifty One and Forty Six beginning at a Point opposite the residence of William Beadeau. Thence along the western line of said Out Lot Fifty One (51) and Forty Six to the northern boundary line of line Out Lot Forty Six (with

Witnesseth; that in consideration of the sum of $10.00 Per Year, paid by said A. M. Tinsley to the said Mary H. G. Houck in advance, the said Mary H. G. Houck agrees to allow A. M. Tinsley, his heirs, successors or assigns to stretch electric wires and place poles along the East side of the fence through Out Lot 50 near the Cape Girardeau and Thebes Bridge Terminal Railroad Company's right of way, from the point south of Elm Street to the South City limits of Cape Girardeau, Missouri.
It is further agreed that this contract shall run for a period of twenty (20) years from the date here-

Now come the parties herein and by agreement of counsel it is ordered by the Court that this cause be dismissed at the cost of the defendants herein. Etc. It is therefore ordered and adjudged by the court that the plaintiff take nothing by reason of this writ and that the defendants pay all costs in this behalf expended and that execution issue therefor.
Reference is hereby made to the Cape Girardeau Court of Common Pleas, which Court has concurrent original jurisdiction with the Circuit Court of this County in Civil matters; also has original probate jurisdiction. I have not examined the said Common Pleas records at Cape Girardeau, Missouri.
Reference is also hereby made to the Cape Girardeau City Tax Books, (General and Special,) which may disclose delinquent taxes. I have not examined the City Tax Books at Cape Girardeau, Missouri.
